TERMS AND CONDITIONS

Last Updated: June 21, 2026

Welcome to the website of AFRICOM Trading Limited (“Company,” “we,” “us,” or “our”). By accessing or using our website located at www.africomtrading.com (the “Site”), you (“User,” “Buyer,” or “Visitor”) agree to be bound by the following Terms and Conditions. Please read them carefully before utilizing our corporate digital services, submitting inquiries, or requesting product samples.

If you do not agree to all of these terms, you are explicitly prohibited from using this Site and must discontinue use immediately.

1. Corporate Identity & Scope of Services

AFRICOM Trading Limited is a legally registered agricultural commodities exporter operating under the laws of the Republic of Malawi, with primary processing facilities and corporate offices located at Plot NK 151, Maone Industrial Area, Limbe, Blantyre, Malawi.

This Site serves exclusively as a business-to-business (B2B) corporate portal providing information regarding our Bird’s Eye Chilli products, quality assurance protocols, logistics networks, and facilities. The content on this website does not constitute binding commercial offers; all official supply transactions require a separate, mutually signed international trade contract.

2. B2B Nature of Transactions & Content Accuracy

  • Wholesale Operations Only: This Site is structured strictly for commercial procurement entities, spice importers, manufacturers, and brokers. We do not cater to retail consumers or the general public.

  • Information Accuracy: While we make every effort to display accurate, up-to-date descriptions of our agricultural commodities (including Scoville Heat Units, moisture parameters, and grading standards), agricultural products are subject to seasonal and biological variances. Technical data sheets, specifications, and website claims represent historical averages and target metrics, not an absolute guarantee of future batch uniformity.

3. Product Samples & Request Policy

  • Fulfillment Discretion: The submission of a request via our “Request a Batch Sample” form does not obligate AFRICOM Trading Limited to ship product samples. We reserve the absolute right to screen requests, verify corporate registration details, and deny sample fulfillments without disclosing a reason.

  • Freight and Duty Obligations: Unless explicitly agreed upon in writing by our export management team, the recipient (Buyer) is entirely responsible for providing a valid corporate courier account number (e.g., DHL, FedEx) and covering all international shipping costs, customs clearance fees, and import duties at the destination port.

4. Requests for Quotes (RFQ) & Communications

  • Non-Binding Quotes: Any price estimations, Proforma invoices, or structural price quotes delivered electronically through communication pipelines initiated on this Site are tentative, strictly non-binding, and valid only for the duration stated on the official written quotation document.

  • Incoterms Governance: All official international pricing structures discussed (FOB, CIF, CFR) are strictly governed by the International Chamber of Commerce (ICC) Incoterms 2020 frameworks.

5. Intellectual Property Rights

Unless otherwise stated, all materials on this Site—including text, high-resolution product photography, chemical matrix tables, logos, branding elements, and layout designs—are the exclusive intellectual property of AFRICOM Trading Limited and are protected under international copyright, trademark, and intellectual property treaties.

Users are strictly prohibited from copying, distributing, republishing, or utilizing our media assets for commercial purposes without securing prior written consent from our corporate board.

6. Limitation of Liability

To the maximum extent permitted by applicable laws, AFRICOM Trading Limited, its directors, employees, or smallholder network partners shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

  • The use or the inability to safely access this website.

  • Technical outages, server failures, or delivery delays of electronic messages.

  • Direct reliance on the informational content, chemical breakdowns, or specifications hosted on the Site.

  • Any variations in the color, heat, or moisture profile of agricultural goods delivered compared to visual representations displayed on this digital platform.

7. Indemnification

You agree to indemnify, defend, and hold harmless AFRICOM Trading Limited, its subsidiaries, logistics partners, and agents from any claims, liabilities, losses, damages, costs, or legal fees arising out of your misuse of the website, violation of these Terms and Conditions, or infringement of any third-party intellectual property rights.

8. Data Privacy & Lead Collection

Any corporate information, emails, or phone numbers submitted via our contact fields or Fluent Forms are managed securely under our corporate data handling framework. We do not sell or lease corporate lead information to third-party marketing brokers. However, you acknowledge that international data transmissions are never 100% secure, and information is submitted at your own commercial risk.

9. Governing Law & Jurisdiction

These Terms and Conditions, along with any disputes arising out of the digital footprint or usage of this website, shall be governed by, interpreted, and enforced strictly in accordance with the substantive statutory laws of the Republic of Malawi.

By using this Site, you unconditionally submit to the exclusive territorial jurisdiction of the high courts located in Blantyre, Malawi, for the resolution of any legal proceedings.

10. Modifications to Terms

AFRICOM Trading Limited reserves the complete right to alter, update, trim, or totally rewrite these Terms and Conditions at any time without issuing a formal notification to previous site visitors.
